Terms of Service.

The terms that govern your use of MediGrow.

1. Acceptance of terms

By creating an account or using the MediGrow platform ("Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and authorized to enter into agreements on behalf of the clinic or organization you represent.

3. Account & clinic responsibilities

You are responsible for:

  • Keeping account credentials confidential.
  • All activity that occurs under your account.
  • The accuracy of information you provide about your clinic, staff, services and pricing.
  • Ensuring your team's use of the Service complies with applicable laws and professional standards.

4. Subscription, billing & trial

The Service is offered on a subscription basis with a one-time setup fee, as described on the Pricing page. A free trial may be offered at our discretion.

Subscriptions renew automatically unless cancelled before the renewal date. Fees are non-refundable except where required by law or expressly stated.

5. Acceptable use

You agree not to:

  • Use the Service to send unlawful, deceptive, or unsolicited messages.
  • Violate WhatsApp Business Solution Terms or Meta platform policies.
  • Attempt to reverse engineer, resell, or interfere with the Service.
  • Upload malware or attempt to compromise other users' accounts.

6. Patient data & data controller responsibility

Your clinic remains the data controller for patient information processed through the Service. MediGrow acts as a data processor on your behalf and processes patient data solely to provide the Service in line with our Privacy Policy.

7. Mary AI - no medical advice

Mary AI is a communication and qualification assistant. It does not provide medical advice, diagnosis, or treatment recommendations. Clinical decisions are the sole responsibility of qualified clinicians at your clinic.

You are responsible for the rules, scripts, pricing, and booking policies you configure, and for reviewing AI-assisted responses where appropriate.

8. Third-party platforms

The Service integrates with third-party platforms (including Meta / WhatsApp / Instagram, calendar providers, and payment processors). Your use of those platforms is governed by their own terms. We are not responsible for changes, outages, or limits imposed by those providers.

9. Intellectual property

The Service, including software, design, content, and trademarks, is owned by MediGrow or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service while your account is active.

10. Confidentiality

Each party agrees to protect confidential information of the other party with reasonable care and to use it only as needed to provide or use the Service.

11. Service availability & no warranties

The Service is provided "as is" and "as available". We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose, except where required by law.

12. Limitation of liability

To the maximum extent permitted by law, MediGrow's total liability arising out of or relating to the Service is limited to the fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

13. Termination

You may cancel your subscription at any time from the dashboard or by contacting support. We may suspend or terminate accounts that violate these Terms, our policies, or third-party platform rules.

14. Governing law

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the competent courts of Dubai, UAE, unless otherwise required by mandatory law.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the dashboard or by email. Continued use of the Service after changes take effect constitutes acceptance.
